Common Questions

Straight answers to the questions injured New Jersey clients ask us most — about cost, deadlines, medical bills, and what your case may be worth.

How much does a personal injury lawyer cost in New Jersey?+

Nothing up front. Like most New Jersey personal injury lawyers, Onal Injury Law works on a contingency fee — you pay no legal fee unless we win money for you. There are no hourly bills and no retainer. Our fee comes as a percentage of the recovery (capped by New Jersey court rules), and if we don't recover anything, you owe us no attorney's fee. Your initial case review is always free.

How long do I have to file a personal injury claim in New Jersey?+

In most cases, you have two years from the date of the accident to file a personal injury lawsuit in New Jersey (N.J.S.A. 2A:14-2). Miss that deadline and you can lose the right to recover anything. Some claims move faster — for example, injuries involving a government entity may require a formal notice of claim within 90 days. Because deadlines vary, it's best to call an attorney as early as possible so evidence is preserved and nothing lapses.

Who pays my medical bills after a car accident in New Jersey?+

New Jersey is a no-fault state, which means your own auto insurance pays your accident-related medical bills first through Personal Injury Protection (PIP) — regardless of who caused the crash — up to your policy limits. If your injuries are serious and your losses exceed what PIP and the coverage available will pay, you may be able to pursue the at-fault driver for the rest, including pain and suffering. We help you sort out which coverage applies and make sure you're not left paying out of pocket for someone else's negligence.

What is my personal injury case worth?+

Every case is different, but the value generally comes from your medical bills, lost wages, future care, and pain and suffering, weighed against how clear the other side's fault is and how much insurance coverage exists. A minor soft-tissue injury and a permanent, life-changing one are worlds apart. We give you an honest assessment for free — not an inflated promise — and we build the case to maximize what you can actually recover.

Can I still recover money if I was partly at fault for the accident?+

Often, yes. New Jersey follows a modified comparative negligence rule: you can recover damages as long as you were 50% or less at fault, though your award is reduced by your share of responsibility. If you're found more than 50% at fault, you generally can't recover. Insurance companies love to pin blame on the injured person to pay less, so it's worth having a lawyer review what actually happened before you accept that you're at fault.

What should I do after a car accident in New Jersey?+

Take care of your health first — call 911 and get checked out even if you feel okay, since injuries like concussions and soft-tissue damage often show up later. If you can, report the accident to police, photograph the scene and vehicles, and exchange insurance information. Avoid giving a recorded statement to the other driver's insurer and don't accept a quick settlement before you understand your injuries. Then call a New Jersey personal injury attorney — the earlier we're involved, the more evidence we can protect.

How long does a personal injury case take to settle?+

It depends on the complexity of your case and the severity of your injuries. Straightforward claims can resolve in a few months, while serious-injury or disputed-liability cases that go into litigation may take one to three years. We never rush you into a lowball settlement to close a file — we move as quickly as the facts allow while making sure the offer actually reflects what your case is worth.

Do I have to go to court, or will my case settle?+

The large majority of personal injury cases settle without a trial. But we prepare every case as if it's going in front of a jury — thorough investigation, strong evidence, and a demand backed by trial readiness. Insurers know which firms are willing to try a case and which aren't, and that reputation is often exactly why they pay more to settle.

What types of injury cases does Onal Injury Law handle?+

We represent accident victims across New Jersey and New York in car accidents, truck accidents, motorcycle accidents, pedestrian and bicycle accidents, slip and fall / premises liability, dog bites, medical malpractice, nursing home abuse, workplace and construction injuries, traumatic brain injury, and wrongful death. We serve clients throughout Bergen County, Newark, Jersey City, Paterson, Elizabeth, Clifton, Edison, and the surrounding communities.
